These terms govern your use of the website, products and services provided by Kestral Technologies Pvt Ltd ("Kestral", "we", "us"). By accessing our website or engaging our services you agree to these terms.
1. Services
Kestral provides IT development services and Battery as a Service (BaaS) solutions. The precise scope, deliverables, timelines and commercials for any engagement are set out in a separate written proposal, statement of work or subscription agreement, which prevails over these terms in the event of conflict.
2. Use of the website
You may not misuse the website, attempt unauthorised access, interfere with its operation or use it for any unlawful purpose. Content on the website is provided for general information and may change without notice.
3. Fees and payment
Fees, billing cycles, security deposits (where applicable to BaaS subscriptions) and taxes are specified in the applicable order document. Overdue amounts may attract interest and suspension of service.
4. Intellectual property
All trademarks, logos, software and materials made available by Kestral remain our property or that of our licensors. Ownership of custom deliverables transfers as agreed in the relevant contract, typically on full payment.
5. Battery assets
Battery packs, chargers and related hardware supplied under a BaaS subscription remain the property of Kestral unless expressly sold. Subscribers must operate the assets in line with our safety and usage guidelines and report damage, theft or malfunction promptly.
6. Warranties and liability
Services are provided with reasonable skill and care. To the maximum extent permitted by law, Kestral is not liable for indirect or consequential loss, and our aggregate liability is limited to the fees paid for the service in the three months preceding the claim.
7. Termination
Either party may terminate an engagement as set out in the applicable agreement. Sums due for work performed up to termination remain payable and leased assets must be returned in good condition.
8. Governing law
These terms are governed by the laws of India, and the courts having jurisdiction at our registered office shall have exclusive jurisdiction.
